General Terms and Conditions
Clear ordering and fulfilment rules for the Kollár Pakk business webshop, operated for companies and institutions.
This is a translation provided for information. The Hungarian version of this document is the legally binding one.
1. Service provider details
The Service Provider’s places of business: 1037 Budapest, Bojtár utca 37. (Budapest office) and 6728 Szeged, Budapesti út 8. (Szeged plant). Further company and hosting provider details are available in the Imprint.
2. Scope of the GTC and eligible customers
These GTC apply to orders for standard products placed in the business webshop operated on the kollarpakk.hu website and to the related services. The GTC become part of the resulting contract in the version in force at the time the order is submitted.
The webshop serves exclusively businesses, sole traders, institutions or other organisations acting in the course of their business or professional activity and holding a valid tax number (hereinafter: Customer). The natural person placing the order declares that they are authorised to represent the Customer or to place the order on its behalf.
Not a consumer webshop: private individuals acting as consumers cannot place orders directly in the webshop. Should a consumer contract nevertheless be concluded, these GTC do not restrict the mandatory statutory rights to which the consumer is entitled.
In the event of any discrepancy, an individual written agreement between the parties shall take precedence over these GTC.
3. Products, technical data and custom manufacturing
Standard pouches, films, trays, packaging machines and related products can be ordered in the webshop. The product page contains the essential characteristics of the product, the selectable size or version, the unit, the price and – where applicable – stock or delivery information.
Images serve to identify the product. Colour, transparency or surface appearance may differ slightly owing to the display and manufacturing tolerances; the contractual content is determined jointly by the product name, the selected variant, the technical description and the confirmation. In the case of an obvious error in a description or image, the Service Provider will consult the Customer before accepting the order.
Custom products
In the case of a custom size, printing, material structure, barrier, converting or other special parameter, the webshop does not automatically create a contract of sale. The parties set out in a separate quotation, in particular, the approved specification, quantity tolerance, price, any advance payment required, production lead time, sample or print approval and the method of acceptance. In the event of any discrepancy, this separate quotation shall prevail.
4. Technical steps of ordering
- The Customer selects the product, the size or version and the quantity, then adds it to the basket.
- Before the order is submitted, items, variants and quantities can be modified or deleted in the basket.
- The Customer enters and checks the billing, delivery, contact and tax number details, then selects an available collection or delivery method and payment method.
- On the order summary, the Customer checks the products, the net and gross amounts, the delivery charge and the acceptance of these GTC.
- The Customer submits the order, which entails an obligation to pay, using the button clearly indicating this.
Incorrectly entered data can be corrected before the order is submitted by editing the basket and the input fields. After submission, the Customer may request a correction without delay at webshop@kollarpakk.hu; the Service Provider can only guarantee to apply it until fulfilment or production of the order has begun.
5. Binding nature of the offer and conclusion of the contract
Submitting the order constitutes the Customer’s offer to conclude a contract. The system confirms receipt of the order electronically without undue delay. This automatic acknowledgement of receipt does not in itself constitute acceptance of the offer.
If the acknowledgement of receipt does not arrive within 48 hours of submitting the order at the latest, the Customer is released from the binding nature of their offer. The contract is concluded when the Service Provider sends a separate, express confirmation of acceptance or approval of fulfilment. In the event of lack of stock, an obvious pricing error, technical incompatibility or incorrect data, the Service Provider may, before acceptance, offer modified fulfilment or reject the offer.
The language of the contract is Hungarian. A contract concluded electronically – in the absence of a qualified electronic signature – does not qualify as a contract in writing, and the Service Provider does not file it in a separate public register. The Service Provider stores the data of the order and the confirmations for the statutory retention period; they are accessible in the Customer’s e-mail account and, where a registered account is used, in that account.
The Service Provider has not submitted itself to the provisions of any code of conduct.
6. Prices, invoicing and payment
Unless clearly indicated otherwise, the webshop prices for business customers are net prices in Hungarian forints; value added tax and the gross amount payable are shown separately in the basket or on the order summary. The product price does not include the charge for delivery, cash on delivery, packaging surcharge or other optional services where the interface shows these as separate items.
In the case of an obviously incorrect price, for example zero or a price grossly different from the usual value of the product, the Service Provider is not obliged to accept the offer at the incorrect price; in such a case it will communicate the correct price, on the basis of which the Customer may decide whether to maintain the order.
The payment methods actually available for a given order are shown at checkout. These may include, in particular, advance bank transfer, cash on delivery, or payment in cash or by bank card at the designated collection point. For advance bank transfer, the Customer pays after receiving the Service Provider’s confirmation of approval and payment details. The Service Provider issues an electronic or paper invoice in accordance with the applicable tax and accounting rules.
Unless otherwise agreed, the product remains the property of the Service Provider until the full purchase price and associated charges have been paid.
7. Collection, delivery and transfer of risk
The Customer may choose personal collection or delivery according to the options offered at checkout. The delivery method, charge and expected fulfilment time are shown on the order summary or – for custom and international deliveries – in a separate confirmation.
The “in stock” indication is for information only. The committed fulfilment deadline is set out in the confirmation of acceptance. In the event of an obstacle or delay, the Service Provider will notify the Customer without undue delay and offer a new deadline or another solution.
Risk passes on handover of the product in the case of personal collection, and on handover to the Customer or the person authorised to receive it in the case of delivery. The Customer must provide contact details and receiving conditions that make delivery possible. The Customer bears the verified additional costs of any unsuccessful delivery attributable to them.
On receipt, any external damage to the package or shortfall in quantity should, where possible, be recorded in the presence of the carrier. This does not affect the enforcement of rights in respect of defects that become apparent later.
8. Defective performance, statutory warranty and guarantee
The Service Provider performs defectively if, at the time of performance, the product does not meet the quality requirements laid down in the contract, the approved specification or legislation. The Customer must inspect the product after receipt in the manner expected in commercial dealings and report any defect detected without undue delay, together with the relevant documents and the batch or production identifier.
Statutory warranty rights are governed by the provisions of the Hungarian Civil Code applicable to contracts between businesses. The Customer may primarily request repair or replacement, unless this is impossible or would entail disproportionate additional costs compared with the other remedy; failing these conditions, the Customer may exercise the right to a price reduction or to withdraw from the contract as provided by law. Withdrawal is not available on account of an insignificant defect.
For machines and other durable products, the duration and conditions of the guarantee are set out on the product page, in the manufacturer’s guarantee document or in the individual confirmation. The mandatory consumer guarantee does not apply to these contracts, which are concluded exclusively for business purposes. Statutory warranty and guarantee do not cover, in particular, defects resulting from improper use, unapproved technology, improper storage, mechanical damage or unauthorised repair.
Quality notification
For a prompt investigation, write to webshop@kollarpakk.hu stating the order number, a description of the product and the defect, the quantity affected and, where possible, photographs and the production or batch identifier.
9. Order cancellation, withdrawal and returns
As a Customer contracting in the webshop is not a consumer, they are not entitled to the consumer’s 14-day right of withdrawal without giving reasons. The order may be withdrawn before acceptance; once the contract has been concluded, cancellation or the taking back of a non-defective standard product is possible only with the Service Provider’s prior written consent, subject to the agreed costs and conditions.
Once production has begun, an order for a product manufactured to order, cut to size, printed or otherwise made to the Customer’s specification may be modified or cancelled only by separate agreement. The Customer must reimburse the raw material, preparation, production and other direct costs verifiably incurred up to that point.
Returns may only be sent with a pre-agreed reference and to a pre-agreed address. An unauthorised return does not in itself constitute acceptance of the returned goods.
10. Complaint handling and disputes
Complaints may be submitted by e-mail to webshop@kollarpakk.hu, by telephone on +36 70 770 1512 or by letter sent to the Service Provider’s registered office. The Service Provider will respond to written complaints on the merits, in plain language and within 30 days at the latest. The parties will primarily seek to settle any dispute through direct negotiation.
Conciliation board for SMEs
From 1 January 2026, a micro, small or medium-sized enterprise meeting the statutory conditions may, as an end user, refer a dispute relating to the purchase of a product or use of a service to a conciliation board. Up-to-date information on the conditions of the procedure and the competent boards is provided by the Hungarian Chamber of Commerce and Industry.
If negotiation does not lead to a result, the dispute shall be governed by Hungarian law and decided by the Hungarian court having subject-matter and territorial jurisdiction under the rules of the Code of Civil Procedure.
11. Data protection and intellectual property
The processing of personal data related to orders is governed by the Privacy notice. The webshop and its content – including text, images, the product database, visual identity and marks – may be protected by copyright or other intellectual property rights; copying or republishing them for business purposes is permitted only with prior written permission.
12. Liability and force majeure
The parties must cooperate and inform each other without delay of any material circumstance affecting performance. The Service Provider is not liable for damage not attributable to it that results from data incorrectly provided by the Customer, conditions of use not disclosed, technical changes not approved, or the failure of a third party’s system.
Neither party is liable for delay or failure to perform caused by an event beyond its control that was unforeseeable at the time the contract was concluded and could not reasonably be averted, provided that the party concerned notifies the other without delay and takes the measures necessary to mitigate the damage.
These GTC do not exclude or limit liability for damage caused intentionally, damage to human life, physical integrity or health, or damage for which liability cannot otherwise be limited under the law.
13. Final provisions and legal background
The Service Provider may amend the GTC with effect for the future. An amendment does not affect contracts already concluded before its entry into force. If any provision is invalid or unenforceable, this does not affect the validity of the remaining provisions; the parties shall replace the provision concerned with the lawful rule closest to its economic purpose.
Matters not regulated in these GTC are governed in particular by the Civil Code (Act V of 2013), the Act on electronic commerce services, the Acts on value added tax and on accounting, and the applicable sector-specific and product safety rules.
Launch requirement: when the live webshop launches, the checkout button label, the payment and delivery methods, the charges, the confirmation e-mails and the invoicing process must be aligned with these GTC. Whenever the operation or the range of services changes, the GTC must be updated before launch.
